Mani here. The guy who thought filing ITR in India would be easy. Like solving Rubik’s cube underwater. With mittens on.

I moved back in 2017. My first tax filing experience was a disaster. I filed wrong. Got notices. Cried a little. Okay, a lot.

Let me save you some tears and official notices.

Understanding Your Tax Status First 📊

Your residential status determines everything. I spent weeks figuring this out. Then paid a CA to explain it again.

Status

Criteria

Tax Implication

NRI

Outside India 182+ days

Foreign income not taxed

RNOR

Returned to India, NRI for 9 out of 10 previous years

Foreign income not taxed if not derived from Indian business

Resident

In India 182+ days, doesn’t meet NRI/RNOR criteria

Global income taxed

I thought I was RNOR. Filed as resident. Got a scary notice. My CA laughed at me. I now pay his kid’s college tuition with my consulting fees.

Choosing the Right ITR Form 📝

Picking the wrong ITR form is like showing up to a wedding in swimwear. Embarrassing. And possibly illegal.

I filed ITR-1 my first year back. Wrong form. Had to refile. Paid late fees. The government sent me a thank you card. Not really. But they got my money.

Your Situation

Form to Use

My Experience

RNOR with salary income only

ITR-2

Used ITR-1. Bad idea.

RNOR with foreign assets

ITR-2

Used wrong exchange rates. Another bad idea.

Business income

ITR-3/4

Tried to DIY. The worst idea.

I now have calendar reminders about which ITR form to use. My phone has more tax alerts than birthday reminders.

The Dreaded Schedule FA 🌏

If you have foreign assets, Schedule FA will become your nemesis. Mine sent me into therapy.

My first Schedule FA looked like abstract art. My CA actually printed it out to show other clients “what not to do.”

Asset Type

Details Required

Common Mistake

Foreign Bank Accounts

Account number, peak balance, interest

Using year-end balance instead of peak

Property

Address, acquisition cost, current value

Using Zillow for valuation (guess who did this?)

Investments

Name, units, purchase date/price, current value

Forgetting fractional shares

I missed listing a 401k worth about $8,000. The potential penalty was ₹10 lakhs. I skipped meals for a week from stress.

Gathering Documentation 📑

The documents you need would fill a small library. I started with a folder. Ended with a filing cabinet.

Documentation

Why It’s Needed

My Painful Lesson

Foreign Tax Returns

Proof of foreign income

Couldn’t find my US return. Paid expedited fees to get copy.

Bank Statements

Verify interest income

Downloaded incorrect date range. Twice.

Form 16/16A

TDS deductions

Didn’t know I needed this. Found out on filing day.

I now scan every document that even whispers the word “tax.” My cloud storage is 90% tax documents and 10% dog photos.

The Foreign Income Maze 💸

Reporting foreign income correctly is crucial. I did it wrong. Multiple times.

Income Type

Reporting Method

My Epic Fail

Salary Earned Abroad

Report in exempt income if RNOR

Reported as taxable. Math disaster.

I once converted dollars to rupees using Google’s rate. Wrong move. The tax department has specific rates. Found out after filing. Had to amend. My CA’s kids now go to fancy summer camps thanks to my amendments.

TDS and Tax Credits 💰

TDS deductions are tricky for returning NRIs. I learned this the expensive way.

Deduction Type

What Happens

My Costly Mistake

Bank Interest TDS

Higher rate for NRIs

Didn’t submit forms to reduce. Budget surprise!

Foreign Tax Credit

Can claim taxes paid abroad

Didn’t have proper documentation. Couldn’t claim.

I paid double tax on some income because I didn’t understand Foreign Tax Credit rules. That money could have bought a nice vacation. Instead, it bought a government employee a new office chair. You’re welcome, unknown bureaucrat.

Digital Signature Certificate (DSC) 🔑

You need a DSC for filing if you have foreign assets. I didn’t know this until the last minute.

DSC Type

Cost

Processing Time

Class 2

₹1,000-1,500

3-5 days

Class 3

₹2,000-3,000

3-7 days

USB Token

Additional ₹500-1,000

Immediate

I tried filing without DSC first year. System rejected. Had to emergency apply. Paid express fees. The courier probably thought I was receiving classified government documents given my anxiety level.

Filing Deadlines and Extensions ⏰

Missing deadlines is expensive. Ask me how I know.

Status

Regular Deadline

Late Filing Penalty

Regular Returns

July 31

₹5,000 to ₹10,000

Audit Cases

October 31

₹5,000 to ₹10,000

Missing Schedule FA

No extension

₹10 lakh flat penalty

I missed the deadline my first year by two days. Paid ₹5,000 penalty. Could have bought 500 vada pavs. Still think about those uneatten vada pavs sometimes.

Common ITR Filing Errors 🚫

Let me share my greatest hits of mistakes. I’m practically a tax error celebrity.

Error Type

Consequence

My Experience

Wrong Residential Status

Notice/Penalty

Selected resident. Should have been RNOR. Got notice.

Incorrect Bank Details

Refund Issues

Typed one digit wrong. Notice received.

I once submitted without verifying TDS amounts. The system flagged a ₹241 difference. Spent hours hunting for the error. It was a bank interest calculation. My blood pressure medication costs more than that amount.

Finding a Good CA 💼

A good CA is worth their weight in gold. A bad one costs you gold plus stress plus hair loss.

CA Type

Cost Range

Value Proposition

General CA

₹2,000-5,000

May miss NRI specifics

NRI Specialist

₹7,000-15,000

Understands foreign income nuances

Big 4 Firm

₹20,000+

For complex portfolios

I went through three CAs before finding my tax guru. First one filed wrong status. Second one missed Schedule FA. Third one is a genius who saved me lakhs. Cost me more. Saved me more.

The Final Verification Step 📲

Don’t forget verification after filing. I did. Return was invalid. Had to refile.

Verification Method

Time Required

Convenience

Aadhaar OTP

Immediate

Highest

Net Banking

Immediate

High

Physical Form

30+ days

Lowest

DSC

Immediate

Required for foreign assets

I tried verifying with Aadhaar when I needed DSC. System rejected. Had to refile. Paid late fee. My CA now uses me as a cautionary tale in his seminars.

Final Thoughts From a Tax Battle Survivor 🛡️

Filing ITR after returning to India is complicated. But survivable.

I’ve gone from tax confusion to tax competence. Still not tax confidence. That might require reincarnation.

Take it seriously. Be meticulous. Start early.

And remember: Every mistake teaches a lesson. I’ve learned enough lessons to open a tax university.

Got questions about NRI tax filing? Drop them in comments. My pain can be your gain.

Sources and Helpful Links:

Income Tax Department of India: https://www.incometaxindiaefiling.gov.in

ITR Forms and Utilities: https://www.incometax.gov.in/iec/foportal

CBDT Circulars on NRI Taxation: https://www.incometaxindia.gov.in/Pages/communications/circulars.aspx

NRI Taxation Handbook 2023-24: https://www.icai.org/post/handbook-on-taxation-for-non-residents

Back to India Movement Tax Resources: https://backtoindia.com/tax-guide

SBI FCNR and NRE Services: https://sbi.co.in/web/nri/accounts/fcnr-account

Hello folks!
