Mani here. The guy who once got TDS deducted at 30% when it should have been 10%. That mistake paid for a small government office renovation.

I returned to India in 2017. Had no clue about TDS rules. My bank deducted maximum TDS. My investments suffered maximum TDS. I basically volunteered extra tax money to the government.

Let me save you from my expensive education.

What is TDS and Why Should You Care? 🧐

TDS means Tax Deducted at Source. It is advance tax collection. Banks and companies deduct it before paying you money.

I thought TDS was a new TV channel when I first returned. The tax department had other definitions. Those definitions cost me money.

Bank Interest TDS: The First Surprise 🏦

Banks deduct TDS on interest differently for NRIs and residents. I learned this after seeing my bank statements.

Status

TDS Rate

Threshold for TDS

My Costly Experience

Resident

10%

Above ₹40,000 yearly

Initially deducted at 30%

NRI

30%

Above ₹2,500 yearly

Continued for months after return

RNOR

Should be 10%

Above ₹40,000 yearly

Bank kept 30% rate until I complained

I lost thousands in excess TDS because I did not update my bank status. The bank seemed too happy keeping my money. I now suspect they used it for their office party.

The Magic Form 15G/15H 📝

Forms 15G/15H can prevent TDS deduction if your total income is below taxable limit. I did not know these forms existed.

Form

Applicable To

Conditions

My Learning Curve

15G

Under 60 years

Income below taxable limit

Discovered 8 months too late

15H

Senior Citizens

Income below taxable limit

Not applicable to me yet

Validity

One financial year

Must renew annually

Forgot renewal in second year

I could have submitted 15G form. Did not. Paid extra TDS. Had to file returns to claim refund. Waited 7 months for refund. That money could have earned interest. Instead it earned goodwill with tax department.

Fixed Deposit TDS Nightmares 💰

TDS on fixed deposits hits differently. I put all my money in FDs immediately after return. Maximum TDS followed.

Deposit Type

TDS Rate for NRI

TDS Rate for Resident/RNOR

My Tax Journey

Regular FD

30%

10% above threshold

Deducted at 30% for 6 months

Tax Saver FD

30%

10% above threshold

Did not know this existed for months

NRE FD

No TDS

No TDS if NRE status maintained

Found out too late

I placed a large FD when I returned. The bank deducted 30% TDS. I complained after 6 months. Bank blamed me for not updating status. They were right. Still hurt.

Rental Income TDS Rules 🏠

TDS on rental income changes based on tenant and your status. I did not know this when renting out my apartment.

Tenant Type

TDS Rate & Threshold

Documentation Needed

Property Owner Experience

Individual/HUF

5% above ₹50,000 monthly

PAN Card

Tenant deducted 10% instead of 5%

Company

10% regardless of amount

PAN Card

Corporate tenant got it right somehow

No PAN Provided

20%

Any ID Proof

Never make this mistake

My first tenant deducted 10% TDS when rate was 5%. I argued. He showed some outdated rule printout. I gave up. Later learned he was wrong. That extra 5% funded someone’s government office lunch probably.

Mutual Fund and Stock Market TDS 📊

TDS rules on investments shocked me. I sold some US stocks from my Indian account after return. TDS surprise followed.

Investment Type

TDS for Residents

TDS for NRIs

My Tax Experience

Mutual Fund Redemption

No TDS

30% for equity, 10/20% for debt

Deducted at NRI rates initially

Stock Sale Proceeds

No TDS generally

30% on gains for NRIs

Broker kept NRI status for 8 months

Dividends

10% above ₹5,000

20%

Paid maximum rates

My mutual fund redemption faced 30% TDS months after returning. The fund house required 7 documents to update my status. I submitted 6. They rejected. I completed process only after second redemption. First redemption funded government employee bonus probably.

The PAN Card Magic 🪄

Having PAN card prevents higher TDS rates. Not having it invites disaster. I had one but did not share proactively.

Scenario

With PAN

Without PAN

My Documentation Story

Bank Interest

10% for residents

20%

Had PAN but bank had old records

Rent Receipts

5%/10%

20%

Tenant applied wrong rate despite PAN

Consultant Fees

10%

20%

First client deducted 20% despite providing PAN

I once received consulting payment with 20% TDS deducted. I had provided PAN. Client claimed “system error.” That error funded a government department’s tea budget for month.

TDS Certificates: The Hunting Game 🔍

TDS certificates prove tax deduction. Getting them requires detective skills sometimes. I became Sherlock Holmes of Form 16A.

Certificate Type

Issuing Timeline

How to Obtain

My Certificate Chase

Form 16

May/June annually

Employer provides

Got this correctly surprisingly

Form 16A

Quarterly

TRACES portal or deductor

Spent weeks chasing first certificate

Form 16B

15 days of payment

TRACES portal

Did not know this existed for property

I once spent 3 weeks chasing a company for TDS certificate. They responded with “check email sent 2 months ago.” Found it in spam folder. Technology is my enemy sometimes.

Lower TDS Rate Certificates 📄

You can get certificate for lower TDS deduction from Income Tax department. I discovered this one year too late.

Certificate

Purpose

Process Complexity

My TDS Reduction Journey

Section 197 Certificate

Authorize lower TDS rate

Medium

Found out after fiscal year ended

Processing Time

1-3 months

Missed opportunity entire first year

Validity

One financial year

Applied second year successfully

I could have saved lakhs with lower TDS certificate my first year. Instead I gave interest free loan to government through excess TDS. Government did not even send thank you note.

TDS Refund Process: The Waiting Game ⏳

Excess TDS requires refund claims. My first refund experience tested my patience. And sanity.

Refund Process

Timeline

Requirements

My Refund Experience

File ITR

By due date

All TDS certificates

Missed one certificate first time

Processing Time

2-6 months

Correct ITR verification

Waited 7 months for first refund

Refund Interest

6% per annum

After 3 months

Received ₹241 interest. Life changing amount.

My first tax refund arrived exactly when I had forgotten about it. The amount was substantial. The interest on delayed refund bought me one dinner. Not even fancy dinner. Just regular dinner.

TDS for Freelancers and Consultants 💼

Freelance income faces TDS challenges. I started consulting work after return. Faced maximum TDS confusion.

Service Type

TDS Rate

Threshold

My Consulting TDS Drama

Professional Services

10%

Above ₹30,000

First client deducted 20%

Technical Services

2%

Above ₹30,000

Client confused which category applied

Commission

5%

Above ₹15,000

Was classified wrongly as commission once

My first consulting client deducted 20% TDS claiming “foreign consultant rate.” I had provided local address proof, PAN, residency proof. Still faced NRI rates. Some tax officer got promotion from my extra taxes probably.

Final Thoughts From a TDS Battle Survivor 🛡️

Understanding TDS rules saves immediate cash flow. Tax refunds return money but much later.

I went from TDS victim to TDS manager. Still not TDS expert. That requires superior documentation skills.

Update your status everywhere immediately after return. Bank. Mutual funds. Broker. Everywhere.

And remember: The TDS you prevent from being deducted is better than refund you chase for months.

Got questions about TDS rules? Drop them in comments. My expensive education is your free knowledge.

Sources and Helpful Links:

Income Tax Department – TDS Section: https://www.incometaxindia.gov.in/Pages/tax-services/tds-on-salaries.aspx

TRACES Portal for TDS Certificates: https://www.tdscpc.gov.in

TDS Rates Chart 2023-24: https://www.incometaxindia.gov.in/charts%20%20tables/tds%20rates.htm

SBI TDS Guidelines for NRIs: https://sbi.co.in/web/nri/tds-guidelines

CBDT Circulars on TDS Procedures: https://www.incometaxindia.gov.in/Pages/communications/circulars.aspx

Form 15G/15H Portal: https://www.incometaxindiaefiling.gov.in/home

Hello friends!
